1. General

1.1 These Terms of Service ("Terms") govern your access to and use of our website and services provided by Walker Productions, trading as Yappcat, a business established in the Netherlands.

1.2 We sell artist-designed merchandise, including stickers and similar physical products featuring adult-oriented (NSFW) artwork. All products are manufactured by our third-party print-on-demand fulfillment partner and shipped directly to the Consumer.

1.3 By accessing the website, placing an order, or using our services, you confirm that you have read and agreed to these Terms.

1.4 Age Requirement: You confirm that you are at least 18 years old, or the age of majority in your jurisdiction if higher. Our website features an age-gate. Bypassing the age-gate while underage constitutes a violation of these Terms.

1.5 If you do not agree to these Terms or do not meet the age requirement, you must not use our services.

1.6 Our store is hosted on Shopify Inc., which provides the e-commerce platform enabling us to sell our products. Product fulfillment is handled by a third-party print-on-demand service.

3. Governing Law

3.1 These Terms are governed by Dutch law.

3.2 Mandatory consumer protection laws of the consumer's country of residence remain unaffected.

4. Nature of the Content (NSFW Disclosure)

4.1 The Products sold may contain adult-oriented, explicit, or sexually suggestive content intended exclusively for adults.

4.2 Artistic styles, sexual themes, fetishes, and explicit depictions vary by artist.

4.3 Refunds or cancellations are not granted based solely on subjective offense, personal taste, or moral or ethical objections.

5. The Offer and Agreement

5.1 Each offer includes a clear description of the Products, including their nature as physical merchandise, pricing, and shipping costs.

5.2 Product images are illustrative. We may use a combination of digital mockups, 3D renders, and real-life photographs to preview the Products. Minor variations in color, scale, finish, or appearance may occur due to production methods, materials, or display settings.

5.3 All prices are displayed inclusive of Dutch VAT (BTW) for EU/EEA consumers. For orders shipped outside the EU, prices are exclusive of any local import duties or taxes, except where stated otherwise at checkout.

5.4 Product availability depends on the fulfillment region. Not all products may be available for shipping to all destinations. Available products and shipping options are shown at checkout based on the delivery address provided.

5.5 The agreement is concluded when checkout is completed and payment is successfully processed.

5.6 Order confirmation is provided electronically.

5.7 Payment Methods: We accept payments via PayPal and Shopify Payments (including credit card, debit card, and iDEAL). All payments are processed securely through our payment providers. No additional payment surcharges apply.

6. Order Processing and Shipping

6.1 Processing Time: All products are manufactured on demand by our fulfillment partner. Orders are typically produced and shipped within 2 to 7 business days after payment is received. Total delivery time, including production and transit, varies by destination and typically ranges from 5 to 20 business days. During peak periods, production and delivery may take longer.

6.2 Shipping Methods: The shipping method and carrier are determined by our fulfillment partner based on the product type and delivery destination. Tracking information is provided by email after dispatch where available.

6.3 Customs and Duties:

(a) EU/EEA: No customs duties apply to shipments fulfilled within the EU/EEA.

(b) International orders: Shipments to destinations outside the EU/EEA may be subject to customs duties, import taxes, or fees imposed by the destination country. These costs are the sole responsibility of the Consumer and are not included in the product or shipping price, except where stated otherwise at checkout.

7. Risk of Loss

7.1 EU/EEA Consumers: The risk of loss or damage remains with Walker Productions until the Products are physically delivered to the Consumer, in accordance with mandatory EU consumer law.

7.2 Non-EU Consumers: Our delivery obligation is fulfilled when the shipment is handed over to the carrier by our fulfillment partner. Risk of loss or damage passes to the Consumer at that point.

7.3 Non-Delivery Claims: In the event of non-receipt, the Consumer must contact us within a reasonable time. Claims are assessed based on available tracking data and carrier records. For shipments without tracking, claims of non-receipt after 25 business days from dispatch are reviewed on a case-by-case basis. For non-EU consumers, we reserve the right to offer a replacement or store credit rather than a refund for lost shipments. EU/EEA consumers retain the statutory right to a full refund in the event of non-delivery.

8. Right of Withdrawal (EU/EEA Consumers Only)

8.1 Consumers residing in the EU/EEA have the statutory right to withdraw from the contract within 14 days after receipt of the Products, without stating reasons. This is commonly referred to as the cooling-off period (herroepingsrecht).

8.2 To exercise this right, the Consumer must notify us by a clear statement (for example by email to store@yappcat.com). The Model Withdrawal Form in the Appendix to these Terms may be used but is not mandatory.

8.3 Exceptions: The right of withdrawal does not apply to products that have been individually customized based on the Consumer's own input (for example, a custom design or personalized text). Standard catalog products manufactured on demand are not considered personalized for the purposes of this exception.

8.4 Return Costs: The Consumer bears the direct cost of return shipping. This obligation is communicated to the Consumer before the order is placed.

8.5 Refunds: Upon valid withdrawal, all payments received from the Consumer, including standard delivery costs, will be refunded within 14 days using the original payment method.

8.6 Information on Withdrawal: The Consumer will be reminded of the right of withdrawal, including the applicable deadline and instructions for exercising it, in the order confirmation email sent after purchase. The Model Withdrawal Form is available both in the Appendix to these Terms and via a link in the order confirmation email.

9. Non-EU Consumers

9.1 Consumers outside the EU/EEA do not have a statutory right of withdrawal under Dutch or EU law.

9.2 Returns or refunds for dissatisfaction with artwork, artistic style, or moral objections to NSFW content are not accepted.

9.3 Defective or incorrect items are handled in accordance with Article 10.

10. Defective or Incorrect Items

10.1 If an item arrives damaged, defective, or incorrect, the Consumer must contact us at store@yappcat.com within a reasonable time after receipt, including photographs of the issue where possible.

10.2 Approved claims are handled in coordination with our fulfillment partner. Resolution may include a replacement, reprint, or refund at our discretion, taking into account the nature of the defect and applicable consumer protection laws.

10.3 We provide a legal guarantee of conformity under Dutch law, ensuring Products are as described and fit for purpose upon arrival.

10.4 Approved refunds are processed within 14 days via the original payment method.

11. Intellectual Property

11.1 All artworks, designs, illustrations, and images featured on this website are protected by copyright and other intellectual property laws.

11.2 All rights remain with the respective artists or their licensors.

11.3 Purchase of a Product grants a limited, non-exclusive, non-transferable license for personal, non-commercial use only.

11.4 Reproduction, copying, distribution, resale, or creation of derivative works is prohibited without prior written permission.

11.5 Digitizing, scanning, or minting the artwork, including as NFTs, is strictly prohibited.

11.6 Unauthorized use may result in legal action.

12. Complaints and Dispute Resolution

12.1 Complaints may be submitted by email to store@yappcat.com within a reasonable time.

12.2 We aim to respond to all complaints within 14 days of receipt.

12.3 If we are unable to resolve your complaint to your satisfaction, EU/EEA consumers may contact the European Consumer Centre network (ECC-Net) for free advice and assistance with cross-border disputes. More information is available at https://www.eccnet.eu.

12.4 Consumers in the Netherlands may also submit a dispute to an appropriate alternative dispute resolution (ADR) body recognized under Dutch law.

13. Privacy and Data Protection

13.1 Our Privacy Policy is available separately on this website and describes how personal information is collected, used, and disclosed in connection with our store.

13.2 To fulfil orders, your personal information (including name, delivery address, and order details) is shared with our third-party print-on-demand fulfillment partner.

14. Amendments

14.1 We reserve the right to amend these Terms.

14.2 Changes apply only to future orders.
